Are There Time Limits for Filing a Michigan Sexual Abuse and Assault Lawsuit?


Yes, Michigan does have a statute of limitations for these cases. Per Mich. Comp. Laws Ann. § 600.5805(6), you have 10 years to take civil action for crimes involving sexual misconduct.

Survivors of sexual assault or abuse who were children at the time of the abuse may have until their 28th birthday to file a case for damages, or no more than three years from the date of discovery of the harm, per Mich. Comp. Laws Ann. § 600.5851(b)(1). The law also states that the deadline that is the latest deadline will apply.
